Terms of Service

These terms govern your use of Ferry. They describe the service as it actually works, including its limits.

1. The agreement

These Terms of Service are an agreement between you and Chaotic Byte ("Ferry", "we", "us"), which provides Ferry through ferrylink.io. They govern your use of the Ferry dashboard, API, MCP server, SDKs, redirect service, and website.

By creating an account or using Ferry, you agree to these terms and to our Privacy Policy, which is part of this agreement. If you do not agree, do not use Ferry.

2. Eligibility and authority

Ferry is a business service. You must be at least 18 years old to use it. If you are using Ferry for a company or other organisation, you confirm that you have authority to bind that organisation to these terms, and "you" means both you and that organisation.

3. Accounts, workspaces, and roles

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for everything that happens under your account. Tell us promptly at hello@ferrylink.io if you believe your account has been compromised.

Your workspace can have owners, admins, and members. Owners and admins can invite and remove people, change billing, and change settings that affect everyone in the workspace. The workspace owner is responsible for the workspace, for its members' use of Ferry, and for the charges it incurs. A workspace can hold up to 10 projects.

4. API keys

Ferry issues two kinds of key, and the difference matters.

  • Public keys (pk_) are designed to ship inside your app. They are scoped to one project and can only resolve links, record matches, report events, and, if you switch it on, create short-lived links.
  • Secret keys (sk_) have full control-plane access to your workspace. Never ship a secret key in an app, a browser, or a public repository.

You are responsible for keeping secret keys confidential and for all activity performed with your keys. Rotate a key in the dashboard if you think it has been exposed.

5. Your licence to use Ferry

While your account is in good standing, we grant you a non-exclusive, non-transferable, revocable right to access and use Ferry for your internal business purposes, in line with these terms.

Ferry, including the service, the software, its documentation, and its branding, remains our property. You may not copy, resell, sublicense, or reverse engineer the service, use it to build a competing product, remove any notices, or access it by any means other than the interfaces we provide.

6. Your content, apps, and domains

You keep ownership of the links, payloads, campaign data, app information, and other content you put into Ferry, and of the data your apps send us. You grant us the limited right to host, process, and transmit it so we can operate the service for you.

You are responsible for confirming that:

  • you own or are authorised to use the apps, bundle identifiers, package names, store listings, and destination URLs you configure;
  • you control any custom domain you connect to Ferry, and are authorised to point it at our service;
  • you have the rights and any consents needed for the data your apps send us, including the privacy notices and permissions your users are entitled to; and
  • your use of Ferry complies with the app store and platform rules that apply to you.

Custom domains require an active paid subscription. Shared subdomains are subject to our reserved-name list, and we may reclaim a name that infringes someone's rights.

7. Acceptable use

You may not use Ferry to:

  • send anyone to phishing pages, malware, scams, or any destination intended to deceive or defraud;
  • impersonate any person or organisation, or use link previews, domains, or metadata to misrepresent where a link leads;
  • distribute unlawful content, or content that infringes intellectual property rights;
  • cloak or disguise a destination in order to evade a platform's review, a security scanner, or an app store policy;
  • send unsolicited bulk messages, or link from them;
  • attack, probe, overload, or attempt to gain unauthorised access to Ferry, our providers, or another customer's data;
  • generate artificial link opens, manipulate device or network signals, or otherwise try to distort attribution or evade our traffic-quality controls;
  • send us special categories of personal data, government identifiers, health data, or payment card numbers through link payloads or events; or
  • break any law that applies to you or to us.

Abuse of the redirect service harms every Ferry customer, because it puts our shared domains at risk of being blocked. We may investigate suspected abuse and take down offending links.

8. Trials, plans, and billing

Subscriptions renew automatically until you cancel. You can cancel at any time, in the billing portal in your dashboard, in the same number of steps it took to subscribe. Cancellation takes effect at the end of your current billing period, and you keep access until then.

Trial

New workspaces get a 14-day trial with no card required, at Growth-plan limits. When the trial ends, you need a paid plan to keep creating new projects, domains, and links.

Plans and charges

Our current plans and prices are on the pricing page. Charges are in USD and are billed in advance, monthly or annually depending on the interval you choose, and renew automatically for the same interval. Payment is handled by Stripe.

Taxes

Prices exclude taxes. You are responsible for any sales tax, VAT, or similar tax on your purchase, except taxes on our income. Where we are required to collect tax, it is added at checkout.

Failed payments

If a payment fails, we keep your paid access for a grace period of 7 days past the end of the unpaid period so you can fix the payment method. After that, paid access is withdrawn.

Changing plans

You can upgrade or downgrade at any time from the billing portal. Changes and any proration are handled by Stripe according to its standard rules for the change you make. A downgrade that puts you above your new plan's limits may block the creation of new resources until you are back within them.

Refunds

Payments are non-refundable, and we do not provide refunds or credits for partial billing periods, unused capacity, or periods when you did not use the service. Nothing here limits any refund right you have under the law that applies to you.

Price changes

We may change our prices. If we do, we will give you at least 30 days' notice by email before the change applies to your renewal, and you can cancel before it takes effect.

9. Plan limits and traffic classification

Each plan includes a number of billable link opens per billing month, shared across every project in your workspace, and a maximum number of projects. Your billing month resets on your subscription's billing-cycle day, including when you pay annually.

Not every request to a Ferry link counts against your allowance. Every link open is classified when it is captured, as one of:

  • eligible, meaning a genuine visitor opened a valid link. Only eligible opens count toward your allowance.
  • excluded, meaning we identified it as traffic that should not be billed: social media link previews, verified bots, requests with a strongly automated signature, prefetch requests, and known automation tools.
  • unverified (reported as review by the API), meaning Ferry could not confidently verify the open as eligible, such as when browser signals are missing or a single source produces an abnormal rate. Unverified traffic does not count toward your allowance and does not require action from you.

Classification never changes where a visitor is sent. A link works the same either way; only billing is affected. Classification decisions are recorded. If we correct a known-wrong classification in an exceptional support case, we keep an auditable history and recalculate the affected month. Classification relies on signals and heuristics, so it will not be perfect, and we may adjust the rules as abuse patterns change.

Going over your monthly link-open allowance does not break your links. The allowance is soft: usage stays visible in your dashboard above 100%, and we do not throttle deliveries, block link creation, or stop resolving your links because you exceeded it. We would rather your links keep working and talk to you about the right plan.

Project count, custom domains, and paid-plan access are hard entitlements and are enforced. If your usage consistently exceeds your plan we will contact you about moving to a suitable plan, and we may introduce charges or limits for sustained excess usage in future, on notice and never retroactively.

10. What Ferry can and cannot guarantee

Please read this section. It describes real limits of the product.

  • Attribution is a best effort, not a certainty. Deferred matching combines several signals and reports a confidence level with each match. Some matches are deterministic; others are probabilistic and can be wrong or missing. Do not rely on Ferry attribution as a system of record for financial reporting.
  • We depend on platforms we do not control. Apple, Google, app stores, browsers, operating systems, clipboard and privacy settings, and network operators all affect whether a deep link opens an app, whether a deferred match succeeds, and what signals we receive. These behaviours change without our involvement.
  • Custom domains depend on your DNS. A custom hostname works only while your DNS records and certificate validation stay in place, and while your subscription is active.
  • Links can expire. Links you give an expiry date stop resolving at that date. Links created from inside an app with a public key are deleted after 7 days unless you promote them.
  • Analytics are computed on a schedule. Reports are built from processed data and show you how fresh they are. Recent activity may not appear immediately.
  • We do not promise uninterrupted service. We have not published a service level agreement, and we do not commit to a specific uptime figure.

11. Changes, suspension, and termination

We continue to develop Ferry and may add, change, or remove features. If we make a change that materially reduces the service on your paid plan, we will give you reasonable notice and you may cancel.

We may suspend or limit your access without notice if we reasonably believe it is necessary to protect the service, our other customers, or a third party, for example because of a security threat, ongoing abuse, or unlawful use. Otherwise we will give you notice and a chance to fix the problem first. We will restore access once the cause is resolved.

You can stop using Ferry and close your account at any time. We may terminate this agreement on 30 days' notice, or immediately if you materially breach these terms and do not fix it within 10 days of our notice.

We may update these terms. We will post the new version here with a new version number and date, and for material changes we will notify account holders by email or in the dashboard before they take effect. Continuing to use Ferry after that means you accept the updated terms.

12. What happens to your links and data

Your links stop working when your account is terminated. Plan for this before you cancel. Links printed on physical material, embedded in shipped app versions, or shared publicly will stop resolving.

If you cancel, your paid access continues until the end of the period you have paid for. After termination we may disable your links and remove your custom hostnames.

Export anything you need before you terminate. After termination we will delete your content and data in the ordinary course, and you can ask us to delete it sooner by emailing hello@ferrylink.io. We may keep records we need for legal, tax, or accounting reasons, as described in our Privacy Policy.

Sections on your content, acceptable use, fees already due, confidentiality, disclaimers, limitation of liability, indemnity, and governing law survive termination.

13. Data protection

Our Privacy Policy explains how we handle personal information. In short: for your account, billing, and security records we are the controller; for the app-user data you send through Ferry, you are the controller and we act as your processor and service provider, processing that data only to provide the service to you.

You are responsible for having a lawful basis for the data you send us, for giving your users the notices they are entitled to, and for obtaining any consent required in your market. You must not send us the categories of sensitive data listed in section 7.

14. Confidentiality

Each of us may learn non-public information about the other. Both of us agree to protect the other's confidential information with reasonable care, to use it only for this agreement, and not to disclose it except to people who need it and are under similar obligations. This does not apply to information that is public, already known, independently developed, or required to be disclosed by law, in which case we will give notice where we lawfully can.

15. Feedback and publicity

If you send us suggestions, we may use them freely to improve Ferry, with no obligation to you.

We will not use your name or logo as a customer reference, in marketing, or in a case study without your prior written permission.

16. Disclaimers

Ferry is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the service will be uninterrupted, timely, secure, or error free, that attribution or analytics will be complete or accurate, or that deep links will open apps correctly on every device, platform version, or network. Some jurisdictions do not allow certain disclaimers, in which case they apply to you only to the extent permitted.

17. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunities, even if advised that they were possible.

Our total liability arising out of or related to this agreement is limited to the amount you paid us for Ferry in the 12 months before the event giving rise to the claim, or USD 100 if you have paid us nothing.

Nothing in this agreement excludes liability that cannot be excluded by law, including liability for fraud, or for death or personal injury caused by negligence.

18. Indemnity

You will defend and indemnify Ferry against third-party claims, and the reasonable costs and damages that result, arising from your content, your apps and destinations, your domains, your breach of these terms, your violation of law, or your failure to obtain the rights and consents needed for the data you send us. We will notify you of the claim, let you control the defence, and cooperate reasonably with you.

19. Disputes

Before starting formal proceedings, we both agree to try to resolve the dispute informally by contacting the other and allowing 30 days to reach a resolution.

If you are a consumer, or if mandatory law in your country gives you the right to bring proceedings in your local courts or under your local law, nothing here takes that right away.

20. General terms

Entire agreement. These terms and the Privacy Policy are the whole agreement between us about Ferry, and replace any earlier understanding. Any purchase order terms you send us have no effect.

Assignment. You may not assign this agreement without our written consent. We may assign it to an affiliate or in connection with a merger, acquisition, or sale of assets.

Notices. We will send notices to the email address on your account, and they are effective when sent. Send us legal notices at hello@ferrylink.io. Keep your contact details current.

Severability and waiver. If any provision is unenforceable, the rest stays in force and the provision is limited to the minimum extent necessary. A failure to enforce a provision is not a waiver of it.

No agency. Nothing here creates a partnership, joint venture, employment, or agency relationship between us.

Force majeure. Neither of us is liable for a delay or failure caused by something beyond our reasonable control, other than an obligation to pay.
